San
Bernardino County Court is comprised of the following divisions:
Civil, Criminal, Jury, Family, Juvenile, Probate, and Traffic. The Superior Court
has jurisdiction over misdemeanor and felony criminal charges. It also has jurisdiction
over both limited and unlimited matters. If the demand of the complaint, exclusive
of interest, or the value of the property in controversy amounts to $25,000.00
or less, it is a limited civil case. Usually unlimited cases are matters in which
the amount demanded exceeds $25,000.00, the value of the property exceeds $25,000.00,
or damages are prayed for as “according to proof” such as in a personal
injury case where medical damages continue to be incurred beyond the filing of
the complaint.
The Small claims court resolves disputes quickly and inexpensively.
A lawyer may not be brought to court but may be contacted for advice before
assisting court. The claim cannot be for more than $7500. If the claim exceeds
the amount the plaintiff may file a limited civil case or sue in the small claims
court and give up their right to the amount over $2500. The plaintiff cannot
sue more than two cases in small claims court for more than $2500 each during
a calendar year.
The Family Court Services provides the following services:
Child custody and visitation mediation as provided by Family Code 3171, Limited
evaluations in child custody cases may be conducted when ordered by the court
as provided in Family Code 3112, Marital and relationship counseling can be
provided upon petition as provided in Family Code 1830, and Pre-marital counseling
and evaluations for juveniles who petition for a marriage license under Family
Code 302 and 304. There are 86 Superior Courts located in 12 facilities throughout
the county. They serve the communities of Chino, Rancho Cucamonga, Fontana,
San Bernardino, Redlands, Joshua Tree, Big Bear, Twin Peaks, Victorville, Barstow,
and Needles
